General website and project terms for Adsrenaline Marketing Pvt. Ltd. Every client engagement is scoped project by project.
These terms apply to your use of adsrenaline.com and form the general baseline for enquiries and professional services supplied by Adsrenaline Marketing Pvt. Ltd. (“Adsrenaline”, “we”, “us”). A written proposal, statement of work, insertion order, invoice or service agreement accepted for a project (“Project Terms”) may add to or replace parts of these terms. If there is a conflict, the accepted Project Terms control for that project.
1. Project-by-project scope
We do not apply one fixed package to every client. Before work begins, we may define the objectives, services, platforms, markets, deliverables, exclusions, timeline, client dependencies, fees, media budget, billing schedule and approval process for the individual project. Work outside the accepted scope requires a written change, revised estimate or new project.
2. Services
Depending on the accepted scope, services may include advertising strategy, media planning and buying, campaign management, advertising account access or operations, creative and content production, landing pages, websites, conversion optimisation, analytics, tracking, reporting, SEO, lifecycle marketing and consulting. Mention of a capability on this website does not mean it is automatically included in a project.
3. Client responsibilities
- Provide accurate business, product, audience, pricing and performance information.
- Supply required platform, website, analytics and brand access on time.
- Ensure that claims, offers, products, customer data and supplied materials are lawful and properly authorised.
- Review requests and approve or reject work within the agreed timeframe.
- Maintain adequate funds for approved media spend and third-party costs.
Delays in access, information, feedback, payment or approval may change delivery dates and performance expectations.
4. Advertising platforms and account access
Advertising platforms are independent third parties. Account availability, verification, advertising approval, delivery, billing and continued access remain subject to their systems and policies. Where Adsrenaline facilitates advertising account access for an eligible media buyer, the applicable Project Terms will define access, funding, permitted use, fees, ownership, balance handling and operational responsibilities.
Advertising accounts may not be used to misrepresent an advertiser, bypass platform enforcement, run prohibited content or violate applicable law. We may refuse, pause or terminate support where information is incomplete, verification fails, payment is overdue or activity presents a legal, policy, security or reputational risk.
5. Fees, media spend and taxes
Agency or project fees are separate from advertising spend, platform charges, taxes, production purchases, software, creator fees and other third-party costs unless the accepted Project Terms expressly say otherwise. Invoices must be paid according to their stated schedule. We may require a deposit, advance funding or cleared media balance before reserving capacity or launching work.
Overdue amounts may result in paused work or campaigns. The client remains responsible for authorised work completed and non-cancellable commitments made before a pause or termination.
6. Approvals and changes
Email or platform approval from an authorised client contact may be treated as approval to publish, launch, spend or proceed. The client should review factual claims, prices, legal disclosures, targeting restrictions and brand accuracy before approval. Material changes after approval may affect fees and timing.
7. Performance and reporting
We use reasonable professional care but do not guarantee a particular number of impressions, clicks, leads, sales, rankings, revenue, return on ad spend or account lifetime. Outcomes depend on the offer, market, competition, budget, platform decisions, creative, website, sales process, measurement quality and other factors beyond our control. Forecasts and estimates are planning inputs, not promises.
8. Intellectual property
Each party retains ownership of materials it owned before the project. The client gives Adsrenaline permission to use supplied brand assets, data and content only as needed to perform the project. Ownership or licence terms for project deliverables will be defined in the Project Terms. Unless those terms say otherwise, final approved deliverables transfer only after all related fees are paid; working files, methods, templates, tools and pre-existing materials remain ours or our licensors’ property.
9. Confidentiality and data
Each party should protect non-public commercial, technical and customer information received for the project and use it only for the engagement, except where disclosure is authorised or legally required. The client is responsible for having a lawful basis to share personal data and instruct us to use it. Website enquiry information is handled under our Privacy Policy.
10. Cancellation, suspension and refunds
Project-specific notice, cancellation and refund rules are stated in the accepted Project Terms and our Cancellation and Refund Policy. In general, completed work, reserved capacity, launched media, platform charges and non-cancellable third-party costs are payable. We may suspend work for overdue payment, missing access, security concerns or unlawful or policy-violating instructions.
11. Website use
You may use this website for lawful informational and business-enquiry purposes. You may not disrupt its operation, attempt unauthorised access, introduce malicious code, misuse forms, impersonate another person or reproduce substantial site content or brand materials for commercial use without permission.
12. Third-party services
We are not responsible for outages, policy changes, rejected ads, account restrictions, data loss or other acts of advertising platforms, payment providers, hosting companies, software vendors or external websites. Third-party names and trademarks belong to their respective owners and do not imply a partnership or endorsement.
13. Liability
To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, special or consequential loss arising from the website or a project. Any additional limits, exclusions or remedies for client services will be stated in the accepted Project Terms. Nothing in these terms excludes a liability that cannot legally be excluded.
